The CEQ Regulatiens (40 CFR 1500 et seq) you refer to in your letter
of November 21, 1979, were, in fact, published in the November 29, 1978,
edition of the Federal Register. The eight-month deadline given therein
for compliance dealt strictly with direct Federal projects. Agencies
administering programs under Sectien 102(2)D ef NEPA were allowed an additienal
four months for State agencies to adopt implementing procedures.
Accordingly, UDOT was responsible for compliance with the CEQ Regulations
no later than November 30,1979.
On October 31, 1979, by memorandum from William D. Hurley to George
W. Bohn, Division Administrator for FHWA, UDOT gave its assurance that.
By November 30, 1979, all projects which are to be developed under Federal aid
Highway Programs will be advanced in full compliance with 40 CFR 1500
et seq· (Council on Environmental Quality Regulations).
Changes to the UDOT Action Plan reflecting the CEQ Regulations have
been under preparation since November, 1978, but have not been published
pending the reissue of FHPM (Federal-aid Highway Program Manual) 7-7-2 by
FHWA. FHPM 7-7-2 is presently being rewritten to conferm to the CEQ Regulations.
When it is published in final form, UDOT can publish its changes
to the Action Plan.
Under the circumstances described above, UDOT, for the time being,
coordinates with FHWA on a project-by-project basis determining for each
project whether an EIS, EA (Environmental Assessment) is required or
whether the project qualifies as a categorical exclusion as described in
